Divorce for dignity

1. The Delhi High Court said that every person has the right to live with dignity, decency and modesty.
2. It revealed that no one wants to live with constant insults.
3. A bench comprising Justice Sanjeev Schadeva and Justice Vikas Mahajan made these comments while upholding the lower court's grant of divorce to the husband who was a victim of abuse by his wife.
4. They rejected the appeal filed by the ex-wife challenging the verdict of the family court.
5. The lower court held that there was no error in the judgement.
6. That the evidence necessary for the atrocity of the woman was recorded, held that they are sufficient for the application of Section 13(1)(i-a) of the Hindu Marriage Act.

गौरवस्य कृते विवाह-विच्छेदनम्

1. दिल्ली-उच्चन्यायस्थानं प्रत्यपादयत् यत् प्रत्येकस्य व्यक्तेः गौरवेण मर्यादाभिः गाम्भीर्येण च जीवितुम् अधिकारः अस्ति।
2. सदा अवमानैः जीवीतुं कोऽपि नेच्छति इति प्रकाशितम् ।
3. भार्यायाः उत्पीडनं सहतः भर्तुः विवाहस्य विच्छेदानार्थं निम्नन्यायस्थानस्य स्वीकृतिं समर्थयन्ती न्यायमूर्ति-सञ्जीव-सचदेवस्य, न्यायमूर्ति-विकास-महाजनस्य च न्यायपीठिका एवं प्रोक्तवती।
4. कौटुम्बिक-न्यायस्थानस्य विनिर्णयं समाह्वयन्त्याः पूर्व-भार्यायाः याचिका निक्षिप्ता।
5. निम्नन्यायस्थानस्य विनिर्णये कोऽपि लोपो नास्तीति स्पष्टीकृतम्।
6. तस्याः महिलायाः क्रौर्य-व्यवहारं प्रमाणीकर्तुम् आवश्यकं प्रमाणम् अभिलेखितम्, तस्मात् हिन्दु-विवाहाधिनियमस्य 13(1)(आइ-ए)-अनुच्छेदस्य प्रयोगाय तानि पर्याप्तानि इति निर्धारितम्।
